France fined TikTok 5 million euros for forcibly collecting cookies for users

The confusing process of refusing to transfer cookies forces the user to agree to their collection.

The French personal data regulator ( CNIL ) fined TikTok for 5 million euros for its cookie policy, which makes the user agree to transfer them.

The agency investigated the Chinese application for social networks from 2020 to 2022 and found that the mechanism for refusing to transfer cookies is very complex and confusing, thereby encouraging the user to accept all cookies.

According to CNIL, the TikTok cookie policy is contrary to the French Data Protection Act, as « violates the freedom of consent of Internet users ».

During the audit, CNIL found that TikTok subsidiaries in the United Kingdom and Ireland presented a button allowing the site to accept cookies, but « did not introduce a button, so that it’s also easy to refuse to transfer them. To refuse to transfer cookies, you need a few clicks, not one, which contradicts the Data Protection Act ».
